OBRA Trusts (Pooled Payback Trusts)
- Similar to the Special Needs Trust (above), but specifically designed for an individual over age 65 to preserve their own assets.
- This trust is usually used for an elderly individual in a nursing home who wants to qualify for Medicaid yet still reserve assets to “supplement” the Medicaid benefit and provide for services not covered by Medicaid.
- Preserving the beneficiary’s eligibility for Medicaid and Supplemental Security Income (SSI).
- Allowing for greater independence, quality of care, and dignity of life for the elderly person in a nursing home.
